Nigeria: Concerns raised over Nnamdi Kanu’s trial procedure

Lead counsel Aloy Ejimakor has raised concerns about the conduct of Nnamdi Kanu’s ongoing trial, specifically the limited time allocated for the defence to present its case.

Ejimakor said that after the prosecution closed its case in June 2025 — following testimony from five witnesses since the trial began in March — the court gave the defence six days to open its case following the dismissal of a no-case submission. 

According to Ejimakor, Kanu consulted with his legal team and indicated interest in self-representation, requesting additional time to prepare and call witnesses. That request was denied.

The lawyer argued there is a clear disparity between the time given to the prosecution and the defence, and stressed that adequate preparation time is essential for a fair trial. He cited Section 36(6)(b) and (c) of the 1999 Constitution, which guarantees accused persons sufficient time and facilities to prepare a defence and the right to defend themselves in person or through legal counsel.

Ejimakor also noted that jurisdictional issues raised during proceedings remain unresolved, stating that such fundamental matters should be addressed before the trial continues. 

He said the defence was unable to proceed under the current schedule and called for adherence to fair trial standards and due process to ensure justice in the matter.
